User Terms

  1. Status of these Terms
    1. These terms and the documents referenced in them create a legal agreement between You and WeClustr UK Ltd, trading as WeClustr (“we”, “us” or “our”) in relation to the WeClustr website available at www.weclustr.com, or any substitute or replacement for it (together the “WeClustr Site”). You agree that by accessing and/or using the WeClustr Site, You are agreeing to these terms and our Privacy Policy. We are a limited liability partnership registered in England and Wales under the company number 10991863. You agree that You are a company, partnership or other business, or a private individual at least 18 years old at the time You use the WeClustr Site. Use of the WeClustr Site by anyone under the age of 18 is prohibited.
    2. You can access these terms at any time at weclustr.com/terms-conditions. We reserve the right to update these terms from time to time by posting the updated version at that URL. We may do so because we change the nature of our services, for technical or legal reasons, or because the needs of our business have changed. You agree that if You do not accept any amendment to our terms then You shall immediately stop accessing and/or using the WeClustr Site and cancel Your account for the WeClustr Site by contacting us via email at info@weclustr.com.
  2. Definition
    1. For ease of reference the following terms shall have the following meanings in these WeClustr Site Terms of Use:
    2. “Listing”: means a listing in the WeClustr Site setting out a description of an Event, the price for the Event, the period during which the Event may be booked, and any Event Provider Terms;
    3. “WeClustr Site”: means the site operated by us at www.weclustr.com, or any substitute or replacement for it;
    4. “Event Item”: means an event, free or paid which an Event Provider offers in a Listing for booking via the WeClustr Site;
    5. “Event Provider Terms”: means any restrictions or requirements imposed by the Event Provider in the Listing;
    6. “Event Provider”: means a third party business which offers Event Items for sale via the WeClustr Site; and
    7. “You” and “Your”: means the purchaser of any Event Item by means of the WeClustr Site.
  3. Booking Event Items.
    1. Once You place a booking for an Event Item through the WeClustr Site, You will have a binding contract to pay for the Event Item, except when it is free.
    2. Descriptions of the Event Item on the WeClustr Site are for illustrative purposes only and the actual Event Item may vary slightly from those images and/or descriptions.
    3. If You are a consumer, You have legal rights against the Event Provider in relation to any Event Item that is not provided as described in the Listing. If You are in the UK, advice about Your legal rights as a consumer against us or the Event Provider is available from Your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these WeClustr Site Terms of Use will affect these legal rights.
    4. You are not permitted to book any Event Item for resale or use by or on behalf of any person other than You; all Event Items sold on the WeClustr Site are for use by You personally or (if You are a business) for Your employees’ own private domestic purposes only.
  4. Payment
    1. Prices listed for Event Items include VAT where applicable unless it is stated otherwise in the Listing.
    2. Payment for all Event Items must be made at the time of booking in Pounds Sterling by PayPal, or using an online payment facility linked to the WeClustr Site. You will be responsible for protecting the confidentiality of Your WeClustr Site user ID and any password or other security information used by You to access Your account on the WeClustr Site.
    3. We take reasonable care to ensure that our payment facility is available and functioning at all times, but cannot guarantee continuous, uninterrupted or secure access to such payment facility, nor can WeClustr guarantee that the facility is virus or error free. We also try to ensure that Your payments are processed promptly, but it is often difficult to predict the amount of time needed to complete processing because it is dependent upon many factors outside of our control, such as delays in the banking system and/or in card networks. Access to the payment facilities may be occasionally restricted to allow for fixing any problems, maintenance or the introduction of new facilities or services. We will attempt to provide reasonable notice of any interruptions we have advance notice of in relation to such payment
  5. Use of the WeClustr Site.
    1. Whilst You are in compliance with these terms (including the Acceptable Use Policy below), we grant You a non-exclusive, non-transferable, personal, revocable limited licence to access and use the WeClustr Site (but not the related object and source code) for Your own personal private use, in each case provided that such use is in accordance with these terms. You agree not to use the WeClustr Site for anything else.
    2. We have the right to suspend, withdraw or modify the WeClustr Site (in whole or in part) without liability to You in the following circumstances: for technical reasons (such as maintenance, or technical difficulties experienced by us or on the internet); to allow us to improve the usability or functionality of the WeClustr Site; where we have legal reasons for doing so (including privacy or other legal objections to the content or functionality of the WeClustr Site ); because it is no longer economically viable or efficient to provide the WeClustr Site.
  6. Accounts
    1. You agree that You shall take all steps necessary to protect Your log in details and keep them secret. You agree that You shall not give Your log in details to anyone else or allow anyone else to use Your log in details or account.
    2. If You fail to keep Your login details confidential, or if You deliberately or unintentionally share Your login details or account with someone else, You accept full responsibility for the consequences of this and agree to compensate us fully for any losses or harm that may result
  7. Your conduct in relation to the WeClustr Site.
    1. You must comply with all laws applicable in the UK or any other location that You access the WeClustr Site from. If any laws applicable to You restrict or prohibit You from using the WeClustr Site, You must comply with those legal restrictions or, if applicable, stop accessing and/or using the WeClustr Site.
    2. You must at all times abide by WeClustr’s Acceptable Use Policy.
  8. Your breach of these terms
    1. We reserve the right to suspend or terminate Your access to the WeClustr Site (including by deleting Your account) if we reasonably believe that You are in material breach of these terms (including by repeated minor breaches). Any significant breach, including any breach of section 10, is likely to be considered a material breach.
    2. You agree to compensate us, according to law, for all losses, harm, claims and expenses that may arise from any breach of these terms by You.
  9. Intellectual property.
    1. You acknowledge that all copyright, trade marks (including ‘WeClustr’ and the WeClustr logo), and other intellectual property rights in and relating to the WeClustr Site (other than Listings, which remain the property of the Event Provider) are owned by us or licensed to us by our partners.
    2. You must not copy, distribute, make available to the public or create any derivative work from the WeClustr Site or any part of the WeClustr Site unless we have first agreed to this in writing. You must not use any WeClustr trade marks (including ‘WeClustr’ and the WeClustr logo), or other intellectual property rights in and relating to the WeClustr Site without our prior written consent.
    3. If You submit comments, ideas, or feedback to us, You agree that we can use them without any restriction or compensation to You. If we accept Your submission, we do not waive any rights to use similar or related ideas or feedback previously known to us, developed by our employees, or obtained from sources other than You.
  10. Privacy.
    1. We will only collect, process, use and share Your personal information in accordance with our Privacy Policy and as set out in these terms. By using the WeClustr Site, You give Your consent to us collecting, processing, using and sharing Your personal data in this way. If You do not agree to our Privacy Policy You should not access and/or use the WeClustr Site.
    2. We may link to third party websites or services from the WeClustr Site. We make no promises regarding any content, goods or services provided by such third parties and we do not endorse them. We are also not responsible to You in relation to any losses or harm caused by such third parties. You understand that when You provide data to such third parties You are providing it in accordance with their privacy policy (if any) and our own privacy policy does not apply in relation to that data.
  11. Complaints and dispute resolution.
    1. Most concerns can be solved quickly by contacting us at info@weclustr.com.
    2. In the unlikely event that legal action becomes necessary either by us or by You, these terms shall be governed by and construed in accordance with the laws of England and subject to the jurisdiction of the English courts.

WeClustr Acceptable Use Policy

You agree that You will not:

  1. use the WeClustr Site to harm anyone or to cause offence to or harass any person;
  2. use another person or entity’s email address in order to sign up to use the WeClustr Site;
  3. use the WeClustr Site for fraudulent or abusive purposes (including, without limitation, by using the WeClustr Site to impersonate any person or entity, or otherwise misrepresent Your affiliation with a person, entity or the WeClustr Site);
  4. use the WeClustr Site for any commercial or business purpose or for the benefit of any third party or to send unsolicited communications;
  5. remove or amend any proprietary notices or other ownership information from the WeClustr Site;
  6. interfere with or disrupt the WeClustr Site or servers or networks that provide the WeClustr Site;
  7. except as permitted by law, attempt to decompile, reverse engineer, disassemble or hack any of the WeClustr Site, or to defeat or overcome any of our encryption technologies or security measures or data transmitted, processed or stored by us;
  8. ‘spider’, ‘harvest’, ‘scrape’ or collect any information about or regarding other people that use the WeClustr Site, including, but not limited to any personal data or information (including by uploading anything that collects information such as ‘spyware’);
  9. disrupt the normal operation of the WeClustr Site or do anything which is likely to have a negative effect on other users’ ability to use the WeClustr Site;
  10. disobey any requirements or regulations of mobile networks connected to the WeClustr Site;
  11. use the WeClustr Site in violation of any applicable law or regulatory requirement;
  12. attempt to get around technological measures designed to control access to, or elements of, the WeClustr Site;
  13. Claim that You are associated with or endorsed by us unless You have entered into a written agreement with us to that effect;
  14. Republish in bulk any information derived from use of the WeClustr Site;
  15. “White-label” or otherwise hold Yourself out as the originating provider of the WeClustr Site or any material or processes contained in it;
  16. Tamper with, disable or override (or attempt to do any of those things) any security component or process of the WeClustr Site;
  17. Use any technical or other means or process means to “mirror”, “frame”, “scrape,” “crawl” or “spider” any web pages or other services contained in the WeClustr Site;
  18. Attempt to or actually access the WeClustr Site’s promotion and ordering services by any means other than through the WeClustr Site. An example of such other means is attempting to access WeClustr via software-as-a-service platforms that aggregate access to multiple services, which include WeClustr; or
  19. Use the WeClustr Site in any other way not permitted by these terms.
